1. Scope
Diese AGB gelten für jede Bestellung bei thescottish.shop, die über das Internet mittels „Warenkorb“ auf der Internetpräsenz des Vertragspartners erfolgt. Vertragspartner ist die thescottish.shop, Lindenstraße 13, 15566 Schöneiche bei Berlin, Deutschland (nachfolgend „TSS“) genannt und der Verbraucher oder Unternehmer (nachfolgend „Kunde“ genannt). Verbraucher ist jede natürliche Person, die bei TSS zu einem Zweck einkauft, der überwiegend weder ihrer gewerblichen noch selbständigen beruflichen Tätigkeit zuzurechnen ist. Unternehmer ist jede natürliche oder juristische Person oder rechtsfähige Personengesellschaft, die beim Abschluss des Vertrags in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handelt.
These General Terms and Conditions are an integral part of the contract and apply to all contracts—including future contracts—between TSS and the customer. Any general terms and conditions that conflict with or deviate from the provisions below shall not apply. The customer accepts these General Terms and Conditions in their entirety as they stand at the time the respective contract is concluded. The General Terms and Conditions are available on the TSS website under the“General Terms and Conditions”link. In addition, the General Terms and Conditions are sent to each customer with the order confirmation, provided that TSS sends such a confirmation (see “Conclusion of the Contract”).
2. Conclusion of the Contract
Orders can be placed with TSS online at www.thescottish.shop (and on other domains belonging to the company) using the shopping cart. By clicking the “Add to Cart” button, the customer can add the respective item to the virtual shopping cart. The selected items are collected in the shopping cart. This process is non-binding and does not constitute an offer to enter into a contract. After entering payment and shipping information, the customer submits a binding offer to purchase the items in the shopping cart by clicking the “Buy Now” button. Before submitting the order in a binding manner, the customer has the opportunity to verify the accuracy of the information provided and correct it if necessary. TSS confirms receipt of the order immediately after the order is submitted via an automatic confirmation email. However, this email does not yet constitute a binding acceptance of the offer; it merely serves to confirm that the order was transmitted without technical errors. All product offers displayed—including price information—are subject to change and merely constitute non-binding invitations for the customer to submit a purchase offer. TSS may accept the customer’s offer contained in the order within 5 calendar days. If this does not occur (i.e., no order confirmation is issued or the items are not shipped within the specified period), the customer’s offer is deemed rejected. If the customer receives an order confirmation or a shipping notification, the customer’s offer is deemed accepted. The customer is informed of the delivery time on the respective product detail page and before placing the order.
TSS accepts orders only from customers who are at least 18 years of age. Orders from minors may be placed only with the express consent of a parent or legal guardian.
The contract language is exclusively German. As an additional service, TSS offers its customers the option to change the language in the online store. The product descriptions on the foreign-language pages are often abbreviated or incomplete. Order confirmations and other information are not provided in all languages, but only in German or English.
3. Prices, Packaging, and Shipping Costs
The prices listed in the online store at the time of the order apply. All prices are gross prices, including applicable value-added tax, and are stated in euros (€). Prices are per sales unit as indicated and are ex-warehouse. In addition to the listed prices, TSS charges shipping costs. Customers can find the shipping costs applicable at the time of ordering in the shipping cost table at www.TSS.de. TSS does not charge any separate fees for packaging the shipment.
For shipments to non-EU countries, additional customs duties, taxes, and fees apply.

4. Terms of Payment & Retention of Title
Payment Methods
TSS accepts payments via PayPal, credit card (Visa, MasterCard, and American Express), instant bank transfer (Klarna AB), or purchase on account (Klarna AB). TSS uses PayPal (Europe) S.à r.l. et Cie, S.C.A. and Shopify Payments (Shopify International Limited) as payment service providers to process payments.
TSS reserves the right, after reviewing the customer’s information, to choose not to offer certain payment methods and to refer customers to other payment methods. Under no circumstances will TSS cover any costs associated with a financial transaction, such as fees for using a credit card abroad.
When purchasing on account, the customer is informed of the due date for the purchase price on the order summary page before the contract is concluded.
Retention of Title
TSS retains ownership of the goods until full payment has been made. TSS reserves the right not to provide the promised service in the event that it is unavailable. If payment has already been made, the purchase price will be credited to the customer’s account and applied to the next order, or refunded at the customer’s request.
If the ordered goods are to be shipped abroad (particularly to countries outside Europe), any import duties (especially customs duties) are the responsibility of the customer.
Electronic Invoice/Credit Memo
The customer agrees to the electronic transmission of invoices and credit memos.
TSS may, at its discretion, also send the invoice or credit memo to the customer in paper form.
5. Shipping & Delivery Time
Orders can be shipped via Hermes, DHL, DPD, FedEx, or UPS.
Delivery within Germany typically takes 1 to 4 business days after TSS sends the order confirmation.
If delivery to the customer is not possible for reasons within the customer’s control, the customer shall bear the additional costs for redelivery. The customer must ensure that the ordered goods can be delivered to the specified shipping address during normal business and delivery hours. TSS bears the shipping risk if the customer is a consumer. The risk of accidental loss and accidental damage passes to the customer upon delivery of the goods.
TSS reserves the right, at its sole discretion, to engage other companies not mentioned in the first paragraph to handle shipping.
There is no obligation to deliver if timely delivery can no longer be guaranteed due to force majeure or strikes.
6. Receipt of the shipment by the customer
The customer should not accept packages with visible external damage without raising a complaint, as this may make it difficult or impossible to prove that the shipment was damaged during transit, for which TSS would be liable. Therefore, upon receiving a shipment, the customer must ensure that the delivered package is undamaged on the outside. If the package is visibly damaged in such a way that damage to the contents of the shipment is likely, the customer must notify the delivery person and have the delivery person make a corresponding note, a copy of which the customer should request.
7. Gift Certificates and How to Redeem Them
Gift certificates are vouchers that customers can purchase. They can only be redeemed for the purchase of items offered in the online store, but not for the purchase of additional gift certificates. If the balance on a gift certificate is insufficient to cover the order, the difference can be paid using the available payment methods (see Section 4).
Gift certificates and store credit can only be redeemed before the order is completed. The value of a gift certificate cannot be redeemed for cash, nor does it accrue interest.
8. Right of Withdrawal
Customers are entitled to the right of withdrawal as provided for in §13 of the German Civil Code (BGB).
9. Agreement on Who Bears the Costs in the Event of Cancellation
In the event that the right of withdrawal is exercised from the Federal Republic of Germany, it is agreed that TSS will bear the direct costs of the return shipment, provided that the return slip included with the delivery is used. If no return label is included with the shipment, TSS will provide one. This can be requested by email at craig.stevenson[at]thescottish.shop.
If the return label provided by TSS is not used to return the goods to TSS, the customer is responsible for the direct costs of returning the goods.
Customers from other countries are generally responsible for the direct costs of returning the item.
For orders placed from other EU countries and non-EU countries, the following applies: In the event that the customer exercises the right of withdrawal, it is agreed that the customer shall bear the direct costs of returning the goods.
Our customers therefore have the right to cancel their contract in accordance with the following cancellation policy.

Der Kunde kann das Muster-Widerrufsformular oder eine andere eindeutige Erklärung auch auf unserer Webseite [https://www.thescottish.shop] elektronisch ausfüllen und übermitteln. Macht er von dieser Möglichkeit Gebrauch, so werden wir ihn unverzüglich (z. B. per E-Mail) eine Bestätigung über den Eingang eines solchen Widerrufs übermitteln. Zur Wahrung der Widerrufsfrist reicht es aus, dass er die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absendet.Ein Widerrufsrecht besteht nicht bei folgenden Fernabsatzverträgen,

- Contracts for the delivery of newspapers, periodicals, or magazines, with the exception of subscription contracts,
- Contracts for the provision of services in the areas of lodging for purposes other than residential purposes, the transportation of goods, automobile rentals, the delivery of food and beverages, and the provision of other services related to recreational activities, if the contract specifies a specific date or period for the provision of the services,
- Contracts for the delivery of sealed goods that are not suitable for return for health or hygiene reasons if their seal has been broken after delivery.
Consequences of the Revocation
Wenn der Kunde diesen Vertrag widerruft, hat TSS ihm alle Zahlungen, die vom Kunden erhalten wurden, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass er eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt hat), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über seinen Widerruf dieses Vertrages bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das der Kunde bei der ursprünglichen Transaktion eingesetzt hat, es sei denn, mit dem Kunden wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden dem Kunden wegen dieser Rückzahlung Entgelte berechnet. Der Kunde aus der Bundesrepublik Deutschland trägt die unmittelbaren Kosten der Rücksendung, wenn der mitgelieferte oder nachträglich zur Verfügung gestellte Rücksendeschein nicht genutzt wird. Kunden aus anderen Ländern haben die unmittelbaren Kosten der Rücksendung generell zu tragen. Der Kunde muss für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.

Voluntary return policy valid for up to 30 days after receipt of the merchandise
For all orders, TSS grants the customer, in addition to the statutory right of withdrawal, a voluntary right of return for a total of thirty (30) days from receipt of the goods. With this right of return, the customer may withdraw from the contract even after the 14-day right of withdrawal period has expired (see Section 10) by returning the goods to TSS—specifically to the address listed below—within thirty (30) days of receiving them (the period begins on the day after receipt of the goods). Timely shipment is sufficient to meet the deadline. However, the voluntary right of return may only be exercised if the customer returns the goods complete, in their original condition, undamaged, and in the sealed original sales packaging. The voluntary right of return does not apply to the purchase of gift certificates and custom-made items. Returns via standard shipping within Germany are free of charge for the customer.

TSS provides return labels for this purpose, which can be requested by emailing craig.stevenson[at]thescottish.shop.
For the refund, TSS will use the same payment method the customer used for the original transaction, unless otherwise expressly agreed with the customer; under no circumstances will the customer be charged any fees for this refund. Customers from the Federal Republic of Germany are responsible for the direct costs of returning the item if they do not use the return label that was included with the delivery or provided subsequently. Customers from other countries are generally responsible for the direct costs of returning the item.
The statutory right of withdrawal (see Section 10) is not affected by compliance with the rules set forth here regarding the supplementary (voluntary) right of return granted by contract and remains in effect independently of this. Until the expiration of the period for the statutory right of withdrawal, only the statutory conditions listed therein apply. Furthermore, the contractually granted (voluntary) right of return does not limit the statutory warranty rights, which remain fully in effect for the customer.

11. Compensation for Use
The customer is liable for any loss in value of the goods only if the deterioration of the goods and the use made of them go beyond the examination of their characteristics and functionality. The examination of their characteristics and functionality refers to trying on and testing the TSS goods, as is customary in a retail store.
12. Warranty
The statutory warranty provisions apply.
13. Limitation of Liability
The customer’s claims for damages are excluded. This does not apply to the customer’s claims for damages arising from injury to life, body, or health, or from a breach of material contractual obligations (cardinal obligations), as well as liability for other damages resulting from an intentional or grossly negligent breach of duty by the provider, its legal representatives, or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.
In the event of a breach of material contractual obligations, the provider shall be liable only for foreseeable damages typical for this type of contract if such damages were caused by simple negligence, unless the customer’s claims for damages arise from injury to life, body, or health.
The limitations set forth in paragraphs 1 and 2 above also apply in favor of the Provider’s legal representatives and agents if claims are asserted directly against them.
The provisions of the Product Liability Act remain unaffected.
14. Governing Law and Jurisdiction
All legal transactions or other legal relationships with TSS are governed by the laws of the Federal Republic of Germany. The United Nations Convention on Contracts for the International Sale of Goods (CISG) and any other international agreements—even if incorporated into German law—do not apply. In the case of contracts with customers, this choice of law applies only to the extent that it does not deprive the buyer of the protection afforded by mandatory provisions of the law of the country in which the buyer has his habitual residence.
If the customer is a merchant as defined by the German Commercial Code, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all legal disputes arising from these Terms and Conditions and from individual contracts concluded under their terms—including actions relating to promissory notes and checks—shall be the registered office of TSS (Berlin). In this case, however, TSS is also entitled to bring an action at the customer’s place of business.
15. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here:ec.europa.eu/consumers/odr/. However, TSS is neither willing nor obligated to participate in a dispute resolution procedure.
16. Intellectual Property
All image rights and other intellectual property rights, including but not limited to text, graphics, photos, illustrations, and software, are owned by TSS or TSS’s partners or suppliers. This content is protected by copyright and trade law. Use, storage, editing, reproduction, or any other form of processing is prohibited without the express permission of TSS.
17. Disclaimer
With regard to all hyperlinks to other websites, TSS expressly states that it has no influence over the content or design of the linked sites. TSS expressly distances itself from all content on the linked sites and does not endorse such content.
This disclaimer applies to all links displayed and the content of the respective linked pages.
18. Data Protection
